At Diageo, our brands are the principal assets of our business. The brand Intellectual Property needs to be carefully managed, protected and exploited to maintain and grow brand value and minimise risk. The IP legal team helps steward those assets to safe-guard their long-term value for Diageo.
We are currently seeking a dedicated and passionate UK Chartered Trade Mark Attorney to join us and work with the Assistant General Counsel for IP, and the wider Global IP team, to manage Diageo’s global trade mark and design portfolio, with a focus on EMEA including GB trade marks/designs and EUTMs and EU designs. Our portfolio currently stands at approximately 35,000 registered IP rights across the globe.
As the sole Trade Mark Attorney in the Global IP team, the purpose of this role is to ensure the long term value of Diageo’s key brand assets by delivering commercially astute advice. The key focus points for this role are:
• To manage all of Diageo’s GB and EU trade mark and design clearance, filing and prosecution, including handling in-house complex filing strategies and oppositions;
• To navigate GB and EU trade mark and design legislation, case law and registry processes and best practice; and
• To understand in general terms the clearance, filing and prosecution challenges in key non-EU territories in which we operate and be able to navigate the laws of the 180+ markets in which we operate, to help the Global IP team develop commercial and practical, regional and global, clearance and filing strategies. This includes developed and developing territories with widely varying degrees of complexity in terms of IP protection and enforcement.
This role would suit an experienced, qualified CITMA Trade Mark Attorney, who has gained extensive experience of leading trade mark and design filing and prosecution in GB and EU. Previous in-house experience is not essential, although we are looking for someone who has gained experience of effectively influencing clients and business stakeholders and who has a commercial and cost-effective mind-set.
Other qualities we are looking for are an ability and willingness to mentor and manage a team of paralegals, as well as to build and maintain a strong relationship with the Business Partner which handles our docketing work.
